Terms of Service

"PicPlay App", "PicPlay Service" or "Service" means the mobile application and related features provided by PicPlay Team, including AI image generation, image editing, image-to-video generation, payment features, and customer support.

"User" or "you" means any person who downloads, accesses, purchases, or uses the Service.

"Content" means any text prompt, image, video, audio, file, instruction, material, or other information that you submit to the Service, and any image, video, or other output generated through the Service.

"AIGC" means artificial intelligence generated content. PicPlay may provide AIGC features based on technologies such as text-to-image, image-to-image, and image-to-video generation.

"Output" means images, videos, or other results generated by the Service based on your prompts, images, settings, or other inputs.

"Paid Service" means any feature, entitlement, subscription, coins, credits, generation quota, or other digital item that requires payment or redemption inside PicPlay.

"Coins" or "Credits" means consumable digital units that may be used in the App to access certain generation or editing features. The name, amount, price, consumption rules, and validity period of Coins or Credits are displayed in the App.

"Subscription" means an auto-renewable or time-limited paid entitlement offered in the App through Google Play, if such entitlement is available in your region and version of the App.

PicPlay currently does not provide a separate user account system. You do not need to create a PicPlay account to use the App.

Because there is no separate PicPlay account system, your access to certain Paid Services may depend on your app installation, device, Google Play purchase records, and other technical records needed to provide the Service. You are responsible for maintaining access to the Google Play profile used for your purchases.

You may use the Service only if you have the legal capacity to agree to these Terms under the laws applicable to you. If you are a minor, you may use the Service only with the consent and supervision of your parent or legal guardian.

You may not access or use the Service in a way that violates applicable laws, these Terms, third-party rights, or the normal operation and security of the Service.

We may suspend, restrict, or terminate access to the Service or specific features if we reasonably believe that your use violates these Terms, applicable law, third-party rights, or service security requirements.

You are solely responsible for the Content you submit to PicPlay and the Output you generate, save, export, share, publish, or otherwise use outside PicPlay.

You represent and warrant that you have all rights, licenses, permissions, and consents necessary to submit your Content to the Service and to use the Output generated from that Content.

You must not submit, generate, export, share, or use Content that:

1. is illegal, abusive, obscene, pornographic, sexually exploitative, harmful, threatening, harassing, hateful, defamatory, discriminatory, or invasive of privacy;
2. infringes or misappropriates any copyright, trademark, portrait right, privacy right, publicity right, trade secret, or other third-party right;
3. includes personal information, biometric information, face likeness, private images, or sensitive information of another person without lawful authority and valid consent;
4. impersonates another person or falsely suggests endorsement, affiliation, identity, or authenticity;
5. creates or spreads malicious rumors, fake news, fraud, scams, or misleading information;
6. contains malware, viruses, harmful code, or attempts to interfere with the Service or any third-party system;
7. is used for spam, unauthorized advertising, phishing, pyramid schemes, or other improper solicitation; or
8. violates any applicable platform policy, including Google Play policies.

We are not obligated to pre-screen all Content, but we may review, reject, remove, block, or restrict Content or Output when necessary to operate the Service, protect users, comply with law, enforce these Terms, or respond to reports from rights holders, platforms, or authorities.

PicPlay is not a storage or backup service. You should keep your own copies of any Content or Output that is important to you. We are not responsible for loss of Content or Output except where required by applicable law.

AIGC features require you to provide prompts, images, settings, or other inputs. The quality, style, accuracy, legality, and usefulness of Output may vary and are not guaranteed.

You must not use AIGC features to create, assist, or distribute unlawful or harmful Content, including sexually explicit material, non-consensual intimate imagery, content exploiting minors, discriminatory content, harassment, fraud, illegal surveillance, or misleading depictions of real persons or public figures.

You are responsible for reviewing Output before using it. Output may be similar to content generated for other users, may contain errors or unexpected elements, and may not be unique.

PicPlay Team does not claim ownership of Output generated by you through the Service. Subject to these Terms and applicable law, we do not restrict your personal or commercial use of such Output. However, we do not guarantee that any Output is copyrightable, that you own exclusive rights in any Output, or that your use of Output will not infringe third-party rights.

We may process your inputs and Output as necessary to provide generation features, maintain safety and security, improve service reliability, enforce these Terms, and comply with applicable laws and platform requirements, as further described in our Privacy Policy.

PicPlay does not make your prompts, inputs, or Output public by default. PicPlay currently does not provide a public feed, user posting area, user interaction space, copyright trading function, artwork contest, or similar feature for publishing or exchanging user works.

PicPlay Team and its licensors retain all rights, title, and interest in and to the Service, including software, interfaces, models, workflows, designs, text, logos, trademarks, and other materials provided by or on behalf of PicPlay Team.

These Terms do not grant you any ownership of the Service. We grant you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose, subject to these Terms.

You must not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, attempt to extract source code, build a competing service from, or otherwise misuse any part of the Service, except to the extent such restriction is prohibited by applicable law.

If you believe that Content generated or used through PicPlay infringes your intellectual property rights, please contact us at support@picplay.ai and provide sufficient information for us to evaluate the claim, including a description of the work, the allegedly infringing material, your contact information, and evidence of your rights.

PicPlay Paid Services are currently offered through the mobile App and processed by Google Play. We do not currently sell Paid Services through a PicPlay web checkout.

Prices, available plans, Coins, Credits, generation quotas, Subscription benefits, billing periods, and consumption rules are displayed in the App or in Google Play before purchase. We may change available Paid Services, prices, benefits, or consumption rules from time to time, subject to applicable law and Google Play policies.

If you purchase a Subscription through Google Play, the Subscription may renew automatically unless you cancel it through Google Play before the renewal date. Google Play controls the payment method, renewal, cancellation, tax handling, and refund process for Google Play purchases.

If you purchase Coins, Credits, or other consumable digital items, they are delivered digitally and may be consumed when you use generation or editing features. Unless required by applicable law or Google Play policies, consumable digital items are not refundable once delivered or used.

If a generation task fails due to a service error and no usable Output is delivered, PicPlay may return the corresponding Coins, Credits, or quota according to the rules displayed in the App. Content rejected for safety, policy, legal, or rights reasons may not be eligible for return unless the App states otherwise.

Paid Services are for your own use. You must not resell, transfer, trade, or commercially distribute Coins, Credits, Subscriptions, generation quotas, or other Paid Service entitlements.

Paid Services may be unavailable, changed, suspended, or discontinued due to technical issues, platform rules, model provider availability, legal requirements, or business changes. Where required by law or Google Play policies, we will provide remedies for affected paid entitlements.

The Service may rely on third-party providers for payment processing, cloud hosting, content safety, analytics, AI models, and other technical functions. Your use of PicPlay may also be subject to Google Play terms and policies.

We are not responsible for the acts, omissions, outages, billing decisions, refund decisions, or policy enforcement of Google Play or other third-party providers, except where required by applicable law.

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, PicPlay Team disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and uninterrupted operation.

AI-generated Output may be inaccurate, incomplete, unexpected, similar to other output, or unsuitable for your intended use. You are responsible for determining whether Output is appropriate, lawful, and safe for your use.

To the maximum extent permitted by law, PicPlay Team will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to the Service or these Terms.

Nothing in these Terms limits liability that cannot be limited under applicable law.

We may modify, suspend, or discontinue all or part of the Service at any time, including features, models, prices, quotas, Paid Services, or availability, subject to applicable law and platform requirements.

You may stop using PicPlay at any time. Stopping use of the App does not automatically cancel a Google Play Subscription. You must cancel any active Subscription through Google Play.

If these Terms terminate or your access is restricted due to violation, you remain responsible for obligations that arose before termination, including payment obligations, legal responsibilities for your Content and Output, and obligations that by their nature should survive termination.

These Terms are governed by and construed in accordance with the laws of the People’s Republic of China, without regard to conflict of law principles, except where mandatory laws in your jurisdiction provide otherwise.

Any claim or controversy arising out of or relating to these Terms or the Service shall be resolved through individual legal proceedings. You agree not to participate in a class action, collective action, or representative action to the extent such waiver is permitted by applicable law.

Unless otherwise required by applicable law or agreed by both parties, disputes shall be submitted to a competent People’s Court in Chengdu City, Sichuan Province, China.
